These Terms & Conditions govern your use of hausofluxur.org and the real estate media services provided by Haus of Luxur. By using our website or booking our services, you accept these Terms. They work alongside our Service & Booking Agreement, Image Licensing Agreement, and Privacy Policy, which are provided at booking and incorporated by reference.
1. Who We Are
Haus of Luxur is a real estate media studio serving Katy and the Greater Houston area. We provide professional listing photography, aerial and drone media operated under an FAA Part 107 Remote Pilot Certificate, listing video, twilight photography, and AI-assisted virtual staging — with floor plans and 3D tours coming soon.
2. Services, Booking & Pricing
The services we offer are described on our website, and the specific scope of your project is confirmed at booking. Every booking is governed by our Service & Booking Agreement, which covers scheduling, deposits, payment, cancellation, and rescheduling.
Pricing. Our services are priced by property-size bracket, exactly as listed on our website — the bracket price is the price. The only exceptions are luxury or oversized properties and locations outside our standard service area, which may require a custom quote confirmed in writing before booking. All listed prices are exclusive of applicable Texas state and local sales tax, which is added at checkout and itemized on your receipt.
Aerial services. All drone flights are conducted in compliance with FAA regulations. Aerial coverage may be limited, modified, or rescheduled due to weather, airspace restrictions, or safety requirements — safety and legal compliance come before the shot, every time.
3. Payment
Payments are processed through Square. A non-refundable deposit reserves your date, and the remaining balance is due on or before delivery. Final media is released only after payment in full. At our discretion, licensed real estate agents may book without a deposit and be invoiced after delivery.
Satisfaction guarantee. If you are not satisfied with your delivered photos, we will reshoot the property once at no charge. If you remain unsatisfied after the reshoot, we will refund the shoot fee. The guarantee covers photographic quality within our control; it does not cover property condition, weather-limited coverage rescheduled under our weather policy, or requests outside the booked scope. A refund under this guarantee revokes the media license in full: refunded photos and video may not be published, listed, or otherwise used in any form, and any use of refunded media constitutes copyright infringement. Publishing or distributing delivered media constitutes acceptance of the delivery and concludes the guarantee period.
4. Intellectual Property & Licensing
All photographs, video, and media created by Haus of Luxur remain our copyrighted property. Clients receive a limited, non-exclusive license to use delivered media as described in the Image Licensing Agreement. Website content, branding, and portfolio images may not be copied, scraped, or reused without our written permission.
5. Client Responsibilities
By booking, you confirm that you own the property or are authorized to arrange media services for it. You agree to provide safe and timely access, have the property ready for its shoot, and disclose anything we should know in advance — such as gated entry, pets on site, hazards, or HOA and community restrictions. Misrepresentation or failure to provide access may result in additional fees under the Service & Booking Agreement.
6. Acceptable Use
You agree not to use our website for unlawful purposes, attempt to breach its security, scrape its content, or interfere with its operation.
7. Third-Party Services & Links
We use trusted third-party providers — including Square, Formspree, and Google — that operate under their own terms and privacy policies. Links to outside websites are provided for convenience; we are not responsible for their content or practices.
8. Disclaimers
Our services are provided “as is.” We make reasonable, professional efforts to deliver high-quality media within the timeframes we quote, but we can’t guarantee any particular marketing outcome — including that a property will sell, lease, or book within any timeframe or at any price.
9. Limitation of Liability
To the maximum extent permitted by law, our total liability for any claim is capped at the amount you paid for the applicable shoot. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or lost opportunities.
10. Indemnification
You agree to indemnify and hold Haus of Luxur harmless from claims arising out of your misuse of delivered media, your breach of these Terms or the Image Licensing Agreement, or booking media services for a property without proper authorization.
11. Changes to These Terms
We may update these Terms from time to time. The current version — with its effective date — will always be posted on this page, and continued use of the site or our services after changes take effect constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of the State of Texas, with exclusive venue in the state and federal courts located in Harris County, Texas.
